Terms and Conditions
1. Scope of Services
IndiaWapsi.com (the “Company”) acts as a Concierge and Advisory Service Provider. We facilitate connections and provide logistical support in the areas of eldercare, property management, investment advisory, employment, and education.
- Advisory Nature: Our services are advisory in nature. While we provide curated recommendations, the final decision and execution often involve third-party entities (e.g., hospitals, banks, schools).
- Third-Party Contracts: In many cases, you will enter into separate agreements directly with these providers. India Wapsi is not a party to those third-party contracts and is not liable for their performance.
2. Professional Disclaimers
- No Legal/Financial Guarantee: Our investment and tax advice (including RNOR status guidance) is based on current Indian laws, including the Income Tax Bill 2025. However, we are not a Substitute for a Chartered Accountant or a SEBI-registered Investment Advisor unless explicitly stated in your specific plan.
- Medical Disclaimer: For Eldercare, India Wapsi provides care management and emergency coordination. We are not a medical facility. In life-threatening emergencies, we will coordinate with local emergency services (102/108), but we are not responsible for clinical outcomes.
3. Subscription & Payment Terms
- Fees: Service fees are charged as per the plan selected (Annual Subscription or Bespoke Project).
- Taxes: All fees are subject to the prevailing GST (18%) as per Indian tax laws.
- Cancellation & Refunds: * Subscription Services: Cancellations made within the first 7 days of payment are eligible for a 90% refund (10% processing fee).
- Bespoke Projects: Fees for one-time projects (e.g., property sale execution) are non-refundable once work has commenced.
4. Limitation of Liability
To the maximum extent permitted by law, India Wapsi’s total liability for any claim arising out of our services shall not exceed the total fees paid by the client in the 6 months preceding the claim.
- We are not liable for indirect, consequential, or “loss of profit” damages.
- We are not liable for delays caused by government bodies (e.g., RTO, Income Tax Dept, or School Boards).
5. Client Obligations
- Accuracy of Info: You agree to provide accurate and updated information (Passports, OCI, Medical history). Inaccurate data leading to service failure is the client’s responsibility.
- Power of Attorney (PoA): For property and legal services, you may be required to execute a specific PoA. You agree to do so in the format prescribed by Indian law to enable us to act on your behalf.
6. Data Protection (DPDP Act 2023)
By using our services, you consent to the collection and processing of your personal and sensitive data as outlined in our Privacy Policy. You represent that you have obtained the necessary consent from “Data Principals” (e.g., your parents or children) whose data you share with us.
7. Force Majeure
India Wapsi shall not be liable for any failure to perform its obligations where such failure results from any cause beyond its reasonable control, including but not limited to, acts of God, civil unrest, or changes in government regulations.
8. Governing Law & Jurisdiction
These terms are governed by the laws of India. Any disputes arising shall be subject to the exclusive jurisdiction of the courts in Kolkata (or your primary HQ city).
